MFMsoft, LLC (referred to as “Company,” “we,” “us” or “our”) respects your privacy and is committed to protecting your privacy online. The purpose of this document (the “Privacy Policy”) is to explain to you how we use information that we have collected from the products that are purchased from you across your digital, cloud, and web-based systems (the "Site”), such as POS systems that you have connected to our MFMsoft software called Mobi. Mobi is the MFMsoft operating system software that acts as a tool interface between you and your systems. By opting into Mobi, you are licensing and authorizing Mobi to act as your tool to work on your behalf and seamlessly monitor the manage the products you sell.

Mobi is not a third-party service that accesses platforms on your behalf. Instead, it is a tool that you license when opting in, and you use it personally to access your systems and accounts to help you use automation to manage your products more efficiently.

This Privacy Policy describes the product data collected by your Mobi tool, how the product data is used and disclosed, and your rights and choices regarding your product data. This Privacy Policy describes how your product purchasing data is collected, used, and shared using the Company’s Mobi software when a customer purchases from your systems. PERSONAL DATA - WE DO NOT COLLECT. 
“Personal data” is any information that can identify, relate to, describe, be associated with, or be reasonably capable of being associated with a particular individual consumer, such as their name, address, and banking information. Personal data does not include anonymous, de-identified, or non-personal data.

Neither the Company nor your Mobi tool has access to or collected any Personal Data. Mobi does not collect or store personal data from you or your customers. The Mobi tool only captures transactional data related to products sold, which helps you and your business analyze sales performance, improve procurement, increase sales opportunities, manage inventory, and improve your business in other ways.


DIGITAL SYSTEM DATA WE COLLECT. 
If you have linked digital systems such as online menu platforms to your Mobi license, your Mobi tool will update each of the Brand Product assets, such as trademarked images, copyrighted names, and descriptions. Your tool will replace your manual work with automation, making you more efficient, eliminating human error, and ensuring that all your product presence and images are consistent. Each Brand partner of the Company is authorizing you to use their product trademarked images, descriptions, and product information on any of your Digital Systems. Mobi seamlessly keeps your online menus updated with all current Brand product images or information and immediately updates your Digital Systems without any interruptions to your current environment. Also, the Mobi tool will capture your sales and transactional data for you as it flows into your POS system. The consumer sales data captured will be product-related, such as time of purchase, quantity, product details, and more. PRODUCT PURCHASING DATA COLLECTED. 
When your customers purchase products from your Digital Systems, your Mobi tool automatically collects transaction information related to the customer’s transactional information directly associated with products. Your Mobi tool does not collect Personal Identifiable Information (PII) from your customers. The Mobi tool only collects product-related data from Digital Systems, such as the products sold, when the product is sold, details of products sold, etc. This data collection intends to help optimize and support your on-premise and off-premise digital and online sales. Additionally, when your customers make a purchase or attempt to make a purchase, your Mobi tool does not have access to or collect any information about them, including their name, billing address, shipping address, payment information (credit card numbers, email address, and phone number). We refer to this information as “Order Information”.


USE OF PRODUCT DATA. 
The Company primary purpose in collecting your product purchasing data is to facilitate and provide seamless automated and artificial intelligence-driven technology services as tools so that you don’t have to do it manually. You give the Company full consent to use the data by opting in and licensing Mobi as a tool. Where law requires, the Company obtains your consent to use and process your product purchasing data for business purposes. Otherwise, we rely on another authorized legal basis (including but not limited to the performance of a contract or legitimate interest) to collect and process your product purchasing data. We use your product purchasing data to Measure Product Performance. We intend to collect product purchasing data to measure the sales performance of the products sold across your Digital Systems to consumers. We use this information to create performance reports and to analyze trends on the type of products purchased when they were purchased—the quantities purchased to ensure that you’re maximizing the product sales across your Sites.


SHARING OF PRODUCT PURCHASING DATA. 

  1. Affiliates and Service Providers. We share product purchasing data with our affiliates and data partners. Like most businesses, we share product purchasing data with service providers or vendors under contractual agreements.
  2. Advertisers. We may share product purchasing data with our advertising partners. Our advertisers may use the product purchasing data information to display advertisements to their customer base or for other reasons.
  3. Business Transfers. We may transfer product purchasing data as a part of a potential sale, merger, reorganization, or other similar transaction. Under applicable laws, we will use reasonable efforts to notify you of any transfer of personal data to an unaffiliated third party.
  4. Consent. We may disclose your product purchasing data to certain parties without your permission


ADDITIONAL TERMS. 

  1. Behavioral Data Usage. As described above, we use the product data collected to improve the ordering process, enhance the interaction and transaction experience, analyze buying behavior to enhance usage experience, track purchasing tendencies, use AI to maximize purchase opportunities and your customers’ purchasing experience, and much more. Please note that we do not alter our data collection.
  2. Age of Use of Our Software. Our services are not directed to individuals under 18, and we do not knowingly collect personal data from them.
  3. Privacy Policy Updates. We reserve the right, at any time, to modify this Privacy Policy. You should review this Privacy Policy periodically to keep updated on our current policies and practices. We will note the effective date of the latest version of our Privacy Policy at the end of this Privacy Policy.
